Abstract

The following essay aims to convey a theoretical analysis that evidences the imbalance that underlies the discussion concerning abortion, regarding with rights and the fact of being a woman. The theoretical proposal responds to a framework of discussion among a biopolitical interstice, feminism and juridical theory, that is intended to convey the idea of exceptionalism that occurs over women’s bodies when discussing the relationship among abortion, life and rights. Thinking of the idea of exceptionalism as guaranteeing will entail reconsidering the correspondence among women and legal order.
